The Federal Communications Commission (FCC) is giving a six-month grace period to comply with new FM simulcast rules, it was announced on 7/5. This extension means stations have until February 3, 2025, to adjust any simulcasts that exceed the duplication limits set by the reinstated rule.

The new rules adopted by the FCC take effect on August 2. Last month the Commission partially reversed a 2020 decision to eliminate the simulcast rule for FMs while not changing the rule for AMs.

According to the order adopted last month (MB Docket No. 19-310), the Commission will consider waiver requests for the new rules. With the rules taking effect at the beginning of August, the 90-day window for submitting these requests begins immediately. Broadcasters seeking a waiver should submit their paperwork by October 31. The Commission has indicated that stations may be allowed to exceed the cap if there are “special circumstances” necessitating additional flexibility.

The Bureau clarified in a public notice, “Licensees are not precluded from submitting waiver requests beyond the recommended time period. Unless and until a licensee’s waiver request is denied, it may continue duplicating programming beyond the 25% duplication allowance. Additionally, if a licensee’s waiver request is denied, the Commission may grant additional time, not exceeding six months, for the licensee to comply.”

July 6, 2023 – Lake Area Educational Broadcasting Foundation has closed on the $1.25 million agreement with the Northwestern Media for the purchase of 15 full-power FM stations, eight FM translator signals, and six construction permits. The majority of the signals are “Spirit-FM,” while seven signals air “Elevate-FM,” all located in Missouri.
